    Abstract：

    我国立法上对体育赛事节目的性质和保护属于灰色地带,对体育赛事节目定性不同,导致权利主体所享有的权利范围及对侵权行为的规制途径亦不同,从而对具体案件的裁判结果带来不同的影响.通过借鉴国外相关立法和司法实践,将体育赛事节目定性为"录像制品",并通过扩大信息网络传播权的调整范围;明确广播组织权的主体范围;拓展广播组织权中"转播权"的权利范围来保护体育赛事节目的知识产权.
