探析我国劳务派遣法律规制路径

Abstract：
从劳务派遣的发展历史和西方经验来看，劳务派遣的本质是灵活的劳动力需求，其定位是对规范用工的补充。然而，中国的劳务派遣偏离了灵活的劳务需求。本文简要分析了劳务派遣的定义和劳务派遣发展的现状，指出劳务派遣法律约束的重要性，并提出了解决方案调度应采取法治、保障员工的基本权益，促进劳务派遣和良好的合作经营，为企业经济的发展提供有效的帮助，使人们对劳务派遣的信任得到有效的提升。
