    Abstract：

    排污权交易在我国已经试点20多年了，其对环境质量的改善在各试点地区已逐步显现。但我国排污权交易制度却至今未能完整构建起来，这与缺少统一完善的法律体系、区域环境容量难以测定与初始分配方式有待商榷等问题是分不开的。我国排污权交易制度的发展要突破现有困境，需要立足本国国情，从排污权立法、市场构建、总量控制、公众参与等几个方面去考察。
